Terms and Conditions

There are key capitalised terms used in these Terms and Conditions which are defined as follows:

Amuse Platform includes the website located at www.amusestaff.com, all related webpages, the downloadable mobile application “Amuse”, and associated customer support;

Event Staff means an individual looking to work an event or party and who is eligible to register as an “Event Staff” on the Amuse Platform;

Event Host means an individual looking to outsource Event Entertainer jobs and who eligible to register as an “Event Host” on the Amuse Platform.

Other capitalised terms used in these Terms and Conditions have the meaning given to them in the Definitions set out at the end of these Terms and Conditions.

These Terms and Conditions for the Amuse Platform constitute a legal agreement between the Event Staff or Event Host and Airntertainment Pty Ltd, ABN 88616737412, having a principal place of business at 7 Holland Street, Chatswood, Sydney, NSW 2000, Australia (hereinafter, referred to as "Amuse", "we", "us" or "our").

By accessing or using the Amuse Platform, you agree to be bound by these Terms and Conditions. If you object to anything in, or otherwise do not agree to, these Terms and Conditions you are not authorised to use the Amuse Platform. You must not use the Amuse Platform in any way other than in accordance with these Terms and Conditions.

Your use of the Amuse Platform is also governed by the Amuse Privacy Policy and any other terms and conditions contained elsewhere on the Amuse Platform.

 

What is the Amuse Platform?

The Amuse Platform connects individuals looking to outsource jobs and individuals looking to provide services in the field of event organisation and management.

The Amuse Platform provides a venue for Event Hosts to post Event jobs for viewing, and where applicable acceptance, by Event Staff in the community.

Event Hosts may post intermittent / ad hoc Event jobs or Event jobs that are to be provided on a more recurring or regular basis.

The Amuse Platform merely facilitates the making of a private arrangement between Event Hosts and Event Staff.

 

What Amuse is NOT!

Amuse does not itself provide Event organisation and management services and Amuse is not an employment agency. By accessing or using the Amuse Platform, you acknowledge that Event Staff are not employees, contractors, partners or agents of Amuse.

Amuse does not get involved in any contractual or other relationship arising between Event Hosts and Event Staff. Event Hosts and Event Staff are wholly responsible for complying with all applicable laws in relation to work health and safety and any contractual or other relationship that may arise between them.

While Amuse requires Event Hosts and Event Staff to verify their profiles on the Amuse Platform and encourages reviews and ratings of Event Hosts and Event Staff, Amuse does not itself conduct, or assume any responsibility to conduct, any checks in relation to:

  • the suitability, honesty, character or capability of any Event Host or Event Staff;

  • the accuracy of any Event Hosts’ or Event Staffs profiles; nor

  • any Event Hosts’ or Event Staffs’ eligibility to use, or compliance with the Terms and Conditions of the Amuse Platform.

Amuse does not recommend or endorse any Event Host or Event Staff.

Amuse has no control over, and accepts no responsibility or liability for, the acts or omissions of any Event Host or Event Staff, including the services provided by Event Staff.

 

Registration

In order to access and use the Amuse Platform, Event Hosts and Event Staff are required to complete the registration process through the Amuse Platform. If you are not eligible to register as an Event Host or Event Staff you are not authorised to use the Amuse Platform.

You are not eligible to register as an Event Host or Event Staff, or to use the Amuse Platform, if you, or anyone in the location where Amuse services are to be provided, has been the subject of a complaint, restraining order, charge or any other legal action involving violence, abuse, neglect or any other offence that involves endangering the safety of others.

The Amuse Platform may be used for the purposes of making arrangements for the provision of Event Staff services in Australia only.

By accessing or using the Amuse Platform, you represent and warrant that:

  • you meet, and will continue to meet, the eligibility conditions applicable to your registration; and

  • all information provided by you to Amuse is accurate and up-to-date at the time it is provided to us and will contain at least the minimum mandatory information required to activate the Profile.

You agree to update your Profile to ensure that it is up-to-date immediately upon any changes to the information contained in your Profile. You agree to notify us immediately if you cease to be eligible to use the Amuse Platform. Any personal information collected by Amuse will be held and used by Amuse in accordance with our Privacy Policy.

You must not have more than one active account or Profile and neither your account nor your Profile is transferable.

 

Event Staff

To be eligible to register as Event Staff you must be aged 18 years or over and legally eligible to work in Australia.

There is no fee payable by Event Staff to Amuse to register as Event Staff or use the Amuse Platform.

By registering as Event Staff you agree to pay Amuse the % of the Event Cost paid by the Event Host published from time to time on the Amuse Platform (hereinafter, referred to as the “Fee”) as consideration for your use of the Amuse Platform. The Fee is only payable on successful completion of a job.

The Fee is also payable on any Tips.

The Fee is subject to any Special Offer from time to time in relation to which the Event Staff is eligible to participate.

Event Staff must provide us with their date of birth as part of the registration process.

 

Event Host

To be eligible to register as an Event Host, you must verify your Profile with us once posting a job. You can do this by the means of a one-time password sent by SMS to your mobile device.

Event Hosts agree, by allocating a job, to pay the Event Staff the agreed Event Cost. To confirm the Event Booking the full sum is transferred to a holding account until the event is successfully completed and both parties have provided a review.

In addition to the Event Cost, an Event Host may need to pay fees to any Event Staff with which they have made arrangements. These fees are a matter between the Event Host and relevant Event Staff, and Amuse is not involved in any such arrangements.

 

Payment of the Fee

The Fee is payable only by Event Staff. No Fee or other fees are payable by the Event Host to Amuse.

All payments made on the Amuse Platform will be made via PayPal Here, a third party secure payment gateway. PayPal Here is provided by PayPal Australia Pty Limited having a principal place of business at 15/ 1 York Street, Sydney, NSW 2000 and ABN 93 111 195 389. The Amuse Platform uses a secure server so that credit card details provided are transmitted via Secure Socket Layer (SSL) technology; and industry-standard encryption technologies are used when transferring or receiving sensitive information. Unless expressly stated otherwise, the Fee payable to Amuse excludes GST.

Amuse may change the Fee published on the Amuse Platform at any time. The changed Fee will apply to Event Staff on and from their next payment of the Fee. We will notify Event Staff of any change to the Fee prior to the change becoming effective.

Under no circumstance will you be entitled to a refund of a Fee paid by you to Amuse.

You must not pay, or attempt to pay, any Fee through any fraudulent or unlawful means.

 

General user obligations

Amuse grants you a non-exclusive licence to use the Amuse Platform solely for the purpose of registering to become Event Staff or an Event Host and making private arrangements for the provision by (where you are Event Staff) or to (where you are an Event Host) you of Event Staff services in accordance with the provisions of these Terms and Conditions.

You must ensure that the login and password used by you to access the Amuse Platform and the details of your account (and any other information you use to remember these details) are kept in a private and secure manner. You must immediately notify Amuse if you are, or become, aware that there is, or has been, unauthorised use of your login, password or account or any other security breach relating to your account. You are responsible and liable for any person that uses your login and password or any other details of your account to access the Amuse Platform.

You must not, and warrant that you will not:

  • use the Amuse Platform for any activities that breach any laws or infringe a third party’s rights;

  • use the Amuse Platform in any way, or post to or transmit to or via the Amuse Platform, which interferes with other users or defames, abuses, harasses, threatens, menaces or offends any person or prevents any person from using or enjoying the Amuse Platform;

  • knowingly post to or transmit to or via the Amuse Platform any obscene, indecent, inflammatory, pornographic, threatening, harassing, deceptive, fraudulent or otherwise offensive material or material which is defamatory of any person or invasive of another person’s privacy;

  • impersonate another person when using the Amuse Platform or create accounts by automated means or under false or fraudulent pretences;

  • make fraudulent or speculative enquiries, requests, job postings or job acceptances using the Amuse Platform;

  • tamper with, hinder, overburden or impair the operation of the Amuse Platform (or any part of it);

  • knowingly transmit any viruses, worms, defects, Trojan horses, time bombs, or similar disabling or malicious code to or via the Amuse Platform;

  • use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any part of the Amuse Platform;

  • use the Amuse Platform to violate the security of any other device, computer system, phone system or network;

  • modify, adapt, translate or reverse engineer any part of the Amuse Platform; or

  • attempt any of the above acts or engage or permit another person to do any of the above acts.

 

User-Generated Content

The Amuse Platform provides Event Staff and Event Host with an opportunity to post reviews, which may include comments, text and images, hereinafter, referred to as the “User-Generated Content”).  We accept no liability in respect of any User-Generated Content.

By using the Amuse Platform, you agree not to submit any User-Generated Content or other material that meets the requirements set in the section “General user obligations” of these Terms and Conditions.

We reserve the right, in our sole discretion, to modify, delete or remove any User-Generated Content which violates these Terms and Conditions.

By publishing any User-Generated Content, you acknowledge and agree that you will be solely responsible and liable for any claims, costs, expenses, liabilities, losses, and damages arising out of in connection with your User-Generated Content.

By posting your User-Generated Content on the Amuse Platform, you grant Amuse unrestricted, royalty-free, perpetual, and irrevocable rights to use, distribute, adapt, remix, modify, publicly display, publicly perform, excerpt, prepare derivative works of, and reproduce your User-Generated Content.

 

Risk and Liability

Event Hosts and Event Staff are wholly responsible for their participation on the Amuse Platform. You agree that you access and use the Amuse Platform solely at your own risk. It is possible that Event Hosts or Event Staff may use the Amuse Platform in a way that violates these Terms and Conditions. We encourage Event Staff and Event Hosts to exercise caution and perform their own checks and interviews when interacting or dealing with other users of the Amuse Platform.

If you experience problems with another user of the Amuse Platform we recommend that you contact Amuse. Amuse reserves the right, but has no obligation, to monitor disputes, dealings or interactions between users of the Amuse Platform. Amuse has no obligation to assist or involve itself in any way in any dispute, dealing or interaction between users of the Amuse Platform.

You acknowledge that the Amuse Platform is provided “as is”. Amuse does not make any representation or warranty as to the suitability of the Amuse Platform for any purpose; or as to the accuracy, completeness or currency of the content on the Amuse Platform or information posted to or transmitted to or via the Amuse Platform; or the acts or omissions (online or offline), suitability, honesty, character or capability of Event Hosts or Event Staff; or the quality of the services provided by the Event Staff.

Amuse does not exclude, restrict or modify any liability that cannot be excluded, restricted or modified by law, including any liability under the CCA. To the maximum extent permitted by law, Amuse:

  • excludes all implied terms and warranties, whether statutory or otherwise, relating to the Amuse Platform or these Terms and Conditions; and

  • will not be liable to you for any direct, indirect, incidental, consequential, special, punitive or exemplary damages you may suffer arising from, or in any way related to, your use of, your inability to use, or the acts or omissions (online or offline) of any user of, the Amuse Platform in contract, tort (including negligence) under statute or otherwise (including for personal injury, property damage, loss of revenue or profits, loss or corruption of data and any other commercial or economic loss of any kind).

To the extent that Amuse’s liability cannot be excluded, and subject to any rights you may have under the CCA, our maximum liability to you is limited to the total amount (if any) paid by you to Amuse.

You agree to indemnify and hold harmless Amuse and its directors, officers, employees and agents, for any claims made against them and any loss, expense, damage or liability incurred by them in any way related to your use of, or inability to use, the Amuse Platform, or your acts or omissions (online or offline) in any way related to the Amuse Platform (including any breach by you of these Terms and Conditions).

 

Availability

Amuse makes reasonable efforts to ensure that the Amuse Platform is always available. Nevertheless, we cannot guarantee that the Amuse Platform would be always available because the availability of the Amuse Platform may be affected by factors which we cannot control, e.g., bandwidth problems, equipment failure, or acts of God. We do not accept any responsibility for the unavailability of the Amuse Platform caused by such factors.

 

Termination

Amuse reserves the right, but has no obligation, to monitor or review any usage of the Amuse Platform or any content on, or information posted to or transmitted to or via, the Amuse Platform.

Amuse may amend or remove your Profile from the Amuse Platform if we believe that your Profile breaches these Terms and Conditions or if we consider at our sole discretion that it is otherwise appropriate, necessary or desirable to do so.

Amuse may immediately suspend or terminate your account or otherwise limit your access to, and use of, the Amuse Platform if we believe that you have breached these Terms and Conditions or if we consider at our sole discretion that it is otherwise appropriate, necessary or desirable to do so.

You may stop using the Amuse Platform at any time and for any reason.

Amuse may stop making the Amuse Platform available (or any part, service or feature of it) at any time without prior notice.

 

Intellectual property rights

You acknowledge that the copyright in the Amuse Platform, the software, design, text and graphics comprised in the Amuse Platform (hereinafter, collectively referred to as the “Copyright Material”) are owned by, or licenced to, Amuse. You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute or communicate in any way the Copyright Material without our prior written consent.

You may download content from the Amuse Platform solely for your personal viewing but not for any other use, including any commercial use.

The Copyright Material is protected by the intellectual property law of Australia and the applicable intellectual property laws.

 

Advertisements and external websites

The Amuse Platform may contain third party advertisements and links to other websites that are not operated by Amuse. These advertisements and links are provided solely for your convenience. Amuse makes no representation or warranty, and has no responsibility or liability, in relation to these advertisements or websites. You agree that you access and use these advertisements and other websites solely at your own risk.

 

General

From time to time, Amuse may change these Terms and Conditions by posting the amended Terms and Conditions on the Amuse Platform. By continuing to access and use the Amuse Platform after any amendment becomes effective, you agree to be bound by the Terms and Conditions as amended.

Any failure or delay in exercise, or partial exercise, of a right arising from a breach of these Terms and Conditions does not result in a waiver of that right.

If the whole or any part, or the application, of any provision of these Terms and Conditions is void, illegal or unenforceable in any jurisdiction it is severed for that jurisdiction. The remainder of these Terms and Conditions has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of these Terms and Conditions or is contrary to public policy.

Your use of the Amuse Platform is governed by, interpreted and enforced in accordance with the laws of Australia. Disputes arising from your use of the Amuse Platform are exclusively subject to the jurisdiction of the courts of New South Wales.

Definitions

For the purposes of these Terms and Conditions:

CCA means the Competition and Consumer Act 2010 (Cth);

Fee has the meaning given in the “Event Staff” section of these Terms and Conditions;

GST has the meaning given to that term in the A New Tax System (Goods and Services Tax) Act 1999 (Cth), as amended;

Including means including without limitation;

Profile means the profile of an Event Host or Event Staff created by that Event Host or Event Staff as part of the registration process of the Amuse Platform, as may be amended from time to time;

Special Offer means a special offer made from time to time by Amuse in relation to the Fee or amount of the Fee payable by Event Staff or eligible Event Hosts for the use of the Amuse Platform, and any terms and conditions of that special offer;

You or your means anyone accessing or using the Amuse Platform, including Event Hosts or Event Staff.
